Terms

Kublio Cloud terms of service

Version 2.0. Effective 7 October 2026. Supplied by AirbourneIT Pty Ltd (ABN 68 641 157 191), 299 Vincent Street, Leederville WA 6007, Australia.

These terms replace the pilot terms of use (version 1.0 of 10 September 2026). Students: a version written for you is at kublio.com.au/student-terms.

1Definitions

1.1

AirbourneIT, we and us mean AirbourneIT Pty Ltd (ABN 68 641 157 191).

1.2

School and you mean the school or organisation that signs up for a trial of Kublio Cloud or places an Order.

1.3

Kublio or the Platform means the Kublio software, model library and place packs supplied by AirbourneIT.

1.4

Kublio Cloud or the Service means Kublio as a service hosted and operated by AirbourneIT, reached through a web browser or the Kublio apps.

1.5

Authorised Users means the students, teachers and other staff the School allows to use the Service under its account.

1.6

User Content means all work created in Kublio by the School, its students or its staff, including worlds, code, recorded sound and written reflections.

1.7

Customer Data means User Content, and all personal information and other information the School or its Authorised Users put into the Service or that the Service holds for the School, including class rolls.

1.8

Order means a quote, order form or online sign-up for paid use of Kublio Cloud that the School has accepted, and that states what is supplied, for how long and for what fee.

1.9

Subscription Term means the period of paid use stated in the Order, including any renewal.

1.10

Trial means the free trial described in clause 3.

1.11

Privacy Statement means the Kublio privacy statement published at https://kublio.com.au/privacy, as updated under its own terms.

1.12

Sub-processor means a company AirbourneIT engages that may handle Customer Data in order to provide the Service.

2These terms and who they cover

2.1

These terms are an agreement between AirbourneIT and the School. They apply to the Trial and to every Order.

2.2

These terms cover Kublio Cloud. Kublio Server, which a school installs and runs on its own computer, is supplied under its own licence. On Kublio Server the School's information is held on the School's own computer and AirbourneIT holds none of it, so clauses 9, 10.2 and 13.5 to 13.7 of these terms do not describe it.

2.3

If an Order and these terms disagree, the Order applies, but only to the extent that it expressly says it is changing these terms. Nothing in an Order reduces the School's rights under clauses 5, 8, 9, 11 or 13.5 to 13.7.

2.4

The person who accepts these terms on behalf of the School confirms that they are authorised to do so.

2.5

These terms replace the Kublio terms of use (version 1.0, 10 September 2026) that applied to pilot and evaluation use. A school that took part in a pilot has been told before these terms took effect.

3Free trial

3.1

A School may use Kublio Cloud free of charge for 7 days as a Trial. There is no fee for the Trial and the School is not committed to buying anything at its end.

3.2

During the Trial the Service carries the same privacy, security and data protections as paid use. Everything in clauses 5, 8, 9, 10 and 11 applies to the Trial in full.

3.3

At the end of the Trial the School's access continues only if the School places an Order.

3.4

If the School does not place an Order, it is treated as a School that has left under clause 13.5: it has 30 days after the Trial ends to export its Customer Data, after which AirbourneIT deletes it, including from backups, and confirms the deletion in writing.

4Your right to use Kublio Cloud

4.1

AirbourneIT grants the School a non-exclusive, non-transferable right to use Kublio Cloud with its own students and staff, for its own educational purposes, during the Trial and each Subscription Term, within any limits on seats or features stated in the Order.

4.2

The School decides who its Authorised Users are, creates and removes their accounts, and is responsible for their use of the Service. Students do not create their own accounts.

4.3

Kublio Cloud is designed for students from Year 4 upwards. These terms set no other age limit; the School decides which of its students use it.

4.4

A real name is not required. An account needs only a display name, which may be a first name, a nickname or a label the School chooses, and nothing in Kublio checks it against any other record.

4.5

Authorised Users must keep their sign-in details to themselves. The School should tell us promptly at info@kublio.com.au if it believes an account has been used by somebody else.

5Who owns what

5.1

The School and its students keep ownership of all User Content they create. Work made by a member of staff belongs to the School or to that person's employer, as their employment arrangements provide.

5.2

AirbourneIT claims no ownership of User Content. The only use AirbourneIT makes of it is to store, copy, display and transmit it as needed to provide the Service to the School and its Authorised Users, and as the School directs. That permission gives AirbourneIT no right to distribute, publish, perform or display User Content to anybody else, and it ends when the Customer Data is deleted.

5.3

AirbourneIT will not use the School's or a student's work to promote Kublio without first obtaining the School's written permission.

5.4

Kublio, including its software, model library and place packs, remains the property of AirbourneIT, subject to clause 7. It is licensed to the School, not sold.

5.5

Anything AirbourneIT makes for a School under a separate paid engagement is governed by that engagement's own agreement.

6Acceptable use

6.1

The School and its Authorised Users must not:

(a) redistribute the Kublio software or model library outside the School;

(b) extract, scrape or repackage the model library or place packs for any other use;

(c) attempt to access another School's data, or another person's work that they have not been given access to;

(d) share sign-in details, or sign in as somebody else;

(e) try to get around the Service's security, sign-in, seat limits or licence;

(f) put into the Service anything unlawful, or anything that harms, threatens or humiliates another person; or

(g) use Kublio unlawfully or in a way that puts a child at risk.

6.2

Anybody who finds a way to see something they should not, or a weakness in the Service, should report it to info@kublio.com.au and not use it. Reporting a weakness in good faith is never a breach of these terms.

6.3

The School is responsible for making the rules in clause 6.1 known to its Authorised Users. A version written for students is published at kublio.com.au/student-terms.

6.4

If AirbourneIT reasonably believes that an Authorised User has breached clause 6.1, it may remove the content concerned or suspend that user's account. It will tell the School first and say why, unless acting first is necessary to protect a child, to protect the security of the Service or of other schools, or to comply with the law. In that case it will tell the School as soon as it has acted.

7Cultural material

7.1

Place packs and any material relating to a community remain the property of that community.

7.2

The School may use that material within Kublio for teaching. The material must not be extracted, altered, repackaged or published elsewhere.

7.3

A community may require material to be withdrawn. A withdrawal request is binding on AirbourneIT and the School.

8Customer Data and privacy

8.1

The School remains responsible for its students' information and controls its Customer Data. AirbourneIT handles Customer Data on the School's instructions, for no purpose of its own, and in accordance with the Privacy Statement. The Privacy Statement says what information the Service holds, why, and for how long.

8.2

AirbourneIT does not sell, rent, trade or share Customer Data, and does not use it for advertising, marketing, market research or profiling. There is no advertising in Kublio. This applies equally to information that has been de-identified or combined with other schools' information.

8.3

AirbourneIT discloses Customer Data only:

(a) to the School and the Authorised Users the School allows to see it;

(b) to its Sub-processors under clause 9.3, only so far as they need it to run the Service;

(c) with the School's consent; or

(d) where the law requires it. AirbourneIT will tell the School before disclosing under this paragraph unless the law prevents it.

8.4

AirbourneIT does not use Customer Data to train, develop or improve any artificial intelligence or machine learning model, and does not allow anybody else to. Kublio Cloud does not send Customer Data to any artificial intelligence service. If AirbourneIT ever offers a feature that would, it will tell the School in advance what the feature sends and to whom, and the feature will be off unless the School turns it on.

8.5

AirbourneIT does not contact students. A request about a child's information is made through the School, and AirbourneIT will help the School answer it.

8.6

The School can see, export, correct and delete the information held about any one person itself, from the teacher area of the Service. A request made to AirbourneIT for access to, correction of or deletion of personal information is answered free of charge within 30 days.

8.7

AirbourneIT sends marketing email only to school staff who have asked to receive it, and never to students. Messages about the Service itself, such as notice of an outage, an incident, a change under clause 9.4 or 16, or a renewal, are not marketing and are sent regardless.

9Where Customer Data is held

9.1

Customer Data, including every backup, is stored in Australia. The Service runs on servers in Sydney.

9.2

AirbourneIT personnel and contractors who can reach Customer Data do so from Australia or New Zealand. A member of AirbourneIT's technical staff works from New Zealand and may administer the Service from there, for example to support a School. That access is over an encrypted connection, Customer Data stays stored in Australia, and none of it is copied out of Australia.

9.3

AirbourneIT uses a small number of Sub-processors to run the Service. It publishes at kublio.com.au/sub-processors, and gives to any School that asks, a list naming each one, what it does, what Customer Data it may handle, and the countries in which it may handle it. Each Sub-processor handles Customer Data only on AirbourneIT's instructions.

9.4

AirbourneIT will give the School at least 30 days' notice in writing before any of the following moves to, or expands into, a country other than Australia:

(a) where Customer Data is stored or processed, including backups and any disaster recovery copy;

(b) where AirbourneIT personnel or contractors who can reach unencrypted Customer Data are located; or

(c) any new Sub-processor, or a change of country by an existing one, where that Sub-processor can reach unencrypted Customer Data.

The notice will name the country, what is moving, why, and the date. If the School does not accept the change, it may end its Order under clause 13.2 and clause 13.4 applies.

10Security, backups, availability and support

10.1

AirbourneIT protects Customer Data with security measures suited to a service used by children, including encryption of data in transit and at rest, keeping each School's data separate from every other School's, and limiting its own staff's access to what is needed to support the School. Where the School asks for help, AirbourneIT asks the School before looking at a child's work.

10.2

AirbourneIT backs up the Service every night. Backups are encrypted and are kept for one year.

10.3

AirbourneIT will use reasonable care and skill to keep the Service available, and will carry out planned maintenance outside usual school hours where it can. No service level, uptime figure or service credit is promised.

10.4

Support is provided by email at info@kublio.com.au, Monday to Friday, 8am to 5pm Australian Western Standard Time, excluding Western Australian public holidays. AirbourneIT aims to reply within one business day.

10.5

Anybody may contact AirbourneIT at info@kublio.com.au to report a fault, a security concern, a privacy complaint or a concern about the safety or wellbeing of a child. A person does not have to be a customer, or give their name, to raise a concern. If a child is in immediate danger, contact the emergency services first.

11Incidents and data breaches

11.1

If AirbourneIT becomes aware of an incident that affects, or may affect, the School's Customer Data, it will tell the School's nominated contact promptly, by phone and in writing on the same day, ahead of any notice to a regulator and before it knows everything about the incident.

11.2

AirbourneIT will tell the School what it knows, what it does not yet know, and what it is doing, and will keep the School informed until the incident is closed.

11.3

Where an incident is likely to cause serious harm, AirbourneIT will notify the regulator as the law requires. Where the people affected are the School's students, the School tells their families and AirbourneIT supports the School in doing so.

11.4

The School should give AirbourneIT the name and contact details of the person to call about an incident, and keep them up to date.

12Fees

12.1

The Trial is free. Paid use is charged at the fees set out in the Order. Fees are in Australian dollars unless the Order states otherwise.

12.2

Fees are invoiced and payable as set out in the Order. Where the Order does not say, fees are payable within 14 days of the date of the invoice.

12.3

A Subscription Term does not renew automatically. About 30 days before it ends, AirbourneIT sends the School a renewal invoice. Paying it renews the Subscription Term for a further year on the terms then current; not paying it lets the Subscription Term end, and clause 13 applies.

13Ending the agreement, and your data

13.1

This agreement starts when the School begins a Trial or places an Order, and continues for as long as the School has a Trial or a Subscription Term.

13.2

The School may end an Order by written notice:

(a) if AirbourneIT materially breaches these terms and has not fixed the breach within 30 days of being told about it; or

(b) if it does not accept a change notified under clause 9.4 or clause 16; or

(c) at any time, for any reason, on 30 days' written notice.

13.3

AirbourneIT may end an Order, or suspend the School's access, if the School materially breaches these terms, including by not paying fees that are due, and has not fixed the breach within 30 days of being told about it in writing. AirbourneIT will always warn the School in writing before ending its access, except where clause 6.4 allows it to act first.

13.4

If the School ends an Order under clause 13.2(a) or 13.2(b), AirbourneIT refunds any fees the School has paid for the part of the Subscription Term after the date the Order ends. If the School ends an Order under clause 13.2(c), no fees are refunded.

13.5

When the School leaves, because a Trial ends without an Order, a Subscription Term ends without renewal, or the agreement is ended under this clause, the School has 30 days to export its Customer Data. After that, AirbourneIT deletes the School's Customer Data from the Service, and it leaves AirbourneIT's backups as they expire, within one year. AirbourneIT confirms in writing when each has happened. A backup is never used to bring back a School's deleted Customer Data, except at that School's own request.

13.6

If the School asks AirbourneIT to delete all of its Customer Data at any time, AirbourneIT will first offer an export, because deletion cannot be undone. It will then delete the Customer Data from the Service within 30 days of the request, and the Customer Data leaves AirbourneIT's backups as they expire, within one year. AirbourneIT confirms each step to the School in writing, with its date. When a teacher deletes one person, that person's information leaves the Service at once and leaves the backups as those age out, within one year. A backup is never used to bring a deleted person back.

13.7

Exports are free. The School can export any one person's record itself, and AirbourneIT will provide, on request and at no cost, a copy of all of the School's Customer Data in a commonly used, machine-readable form.

13.8

If AirbourneIT decides to stop providing Kublio Cloud, it will give the School at least 90 days' notice in writing, a way to take its Customer Data with it, and a refund of fees paid for any period after the Service stops.

13.9

Clauses 5, 7, 8, 13.5 to 13.7, 14, 15 and 18 continue after this agreement ends.

14Warranties and the Australian Consumer Law

14.1

AirbourneIT will provide the Service with due care and skill, and the Service will work materially as AirbourneIT describes it.

14.2

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy available under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

14.3

Where the law permits AirbourneIT to limit its liability for failing to comply with such a guarantee, that liability is limited to supplying the Service again or paying the cost of having the Service supplied again.

15Limitation of liability

15.1

To the extent permitted by law, AirbourneIT is not liable for indirect or consequential loss.

15.2

To the extent permitted by law, AirbourneIT's total liability arising out of or in connection with these terms, however it arises, including for a breach of clause 8 or 9, is limited to the fees the School paid AirbourneIT in the twelve months before the event giving rise to the claim. AirbourneIT holds professional indemnity, public liability and cyber insurance, and gives the School the details on request.

15.3

AirbourneIT is not liable for loss caused by the School or its Authorised Users, or by a third-party service the School chooses to use with Kublio, such as the School's own Microsoft 365 or Google account.

15.4

This clause does not limit clause 14 or any right or remedy that cannot lawfully be limited.

16Changes to these terms

16.1

Each version of these terms carries a version number and an effective date. AirbourneIT reviews them at least once every twelve months, and whenever Kublio Cloud changes in a way that affects them.

16.2

AirbourneIT will tell the School in writing at least 30 days before a change to these terms takes effect, and will say what is changing.

16.3

Where a change materially affects the School's rights, how Customer Data is handled, or where it is held, the School's administrator will be asked to accept the new terms before the School continues to use the Service. A School that does not accept may end its Order under clause 13.2, and clause 13.4 applies.

16.4

A change needed to comply with the law, or that only corrects or clarifies wording without reducing the School's rights, takes effect on the date in the notice.

17Notices

17.1

Notices to the School are sent to the contact email address in the Order or the Trial sign-up. Notices to AirbourneIT are sent to info@kublio.com.au.

17.2

The School should keep its contact details up to date. A notice under clauses 9.4, 11, 13 or 16 is also given to the School's nominated incident contact under clause 11.4, where that is a different person.

18General

18.1

Neither party may transfer its rights under these terms without the other's written consent, which will not be unreasonably refused. AirbourneIT may transfer them to a company that takes over the Service, if that company is bound by these terms and the School is told in writing first.

18.2

Neither party is liable for a delay or failure caused by something outside its reasonable control, provided it tells the other promptly and does what it reasonably can to limit the effect. This does not excuse AirbourneIT from clauses 8, 9 or 11.

18.3

If any part of these terms is unenforceable, the rest continues to apply.

18.4

These terms, the Privacy Statement and any Order are the whole agreement between the School and AirbourneIT about Kublio Cloud.

18.5

These terms are governed by the laws of Western Australia, and each party submits to the courts of Western Australia.

19Contact

19.1

Questions about these terms, and every request and report described in them, may be sent to info@kublio.com.au.
